  • to service providers, such as insurance agents and/ or brokers, claims adjusters, or reinsurers, who are providing services on our behalf and/or otherwise need to access your information to assist us in providing our services
  • to governmental authorities and non-affiliated third parties as permitted by law
  • between and amongst State National and its US subsidiaries and affiliates, including City National Insurance Company, National Specialty Insurance Company, Pinnacle National Insurance Company, State National Insurance Company, Inc., Superior Specialty Insurance Company, and United Specialty Insurance Company
  • to vendors, consultants and service providers who provide IT support, background checks, or online software solutions as part of our services
  • in compliance with laws, at your consent or direction, and to protect rights, property and safety
  • in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your information may be shared as part of such a transaction as permitted by law and/or contract
  • with your consent

We restrict access to personal information about our customers/claimants to those individuals who need to know that information to provide products and services to our customers/claimants or as permitted by law. We train our employees to safeguard personal information. We maintain reasonable physical, electronic, and procedural safeguards to guard your personal information in accordance with applicable data protection laws.

VI. Children’s Privacy

We do not knowingly collect personal information from minors, including children under the age of 13. Our products, services, and website are not intended for use by minors.  If we learn that a user is under this age, we will not use or maintain his/her personal information. If we become aware that we have unknowingly collected personal information from a child under the age of 13, we will make reasonable efforts to delete such information from our records.

Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Sales of Personal Information

We do not and will not sell your personal information, and we have not sold any personal information in the preceding 12 months.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information.   • Access to Specific Information and Data Portability Rights

If we maintain inaccurate personal information about you, you have the right to request the correction of that personal information. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.

  • Right to Limit Sensitive Personal Information

We do not collect or process Sensitive Personal Information for the purpose of inferring characteristics.

  • Exercising Access, Data Portability, Deletion and Correction Rights

To exercise the access, data portability, deletion and correction rights described above, please submit a verifiable consumer request to us by either:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.  You may designate an agent by providing the agent with your written and signed permission to act on your behalf and by directly confirming with us that you have provided the authorized agent permission to submit the request. As permitted by law, we may require you to verify your identity in response to a request even if you choose to use an agent. The authorized agent will also need to verify its own identity directly with us.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative
  • describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Non-Discrimination

In exercising any of the foregoing consumer privacy rights, we will not discriminate against you for exercising any of those rights.  We will not deny you services or provide you a different level of services for exercising your rights, unless the difference is reasonably related to the value of your information.

We will retain your information for as long as required to provide our services, complete the transaction for which your personal information was collected, or as otherwise required or permitted by law. We will retain and use this information as necessary to provide our services, comply with our legal obligations, resolve disputes, or enforce our agreements.

 

XI. Other California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. XII. Other State Specific Rights

You have a right to confirm whether or not we process your personal information as well as to access and receive a copy of the specific personal information we have collected about you.

You have a right to receive the Personal Information, limited to the Personal Information you previously provided to us, in a structured and commonly used format so that it can be transferred to another entity (“data portability”).

You have a right to deletion of your personal information, subject to exceptions under applicable US State Privacy Laws.

You have a right to request correction of any inaccurate personal information we hold about you.

You have a right to opt-out of our sale or our use of personal information for targeted advertising purposes.

Finally, you have a right to receive notice of our practices at or before collection of personal information and you have a right not to receive discriminatory treatment for exercising any of your rights described under this section. We will not discriminate against you based on your exercise of any of your rights.

You can assert these rights only where we receive a verified request from you.

Use of Agents

If you are a consumer in a jurisdiction that recognizes the ability to use an authorized agent and wish to contact us through an authorized agent, the authorized agent can submit a request on your behalf to privacy@statenational.com along with a statement, certified as may be required, that the agent is authorized to act on your behalf. In order to verify the request, we may ask you to verify your identity.

Appeals

If you are in a jurisdiction that recognizes your ability to appeal a decision we have made in connection with your attempt to assert a right under applicable US State Privacy Laws, you may file an appeal of our decision refusing your request to exercise your rights under this Privacy Policy. Requests to change our policies or practices are not grounds for appeal. You may request an appeal of such decision by contacting us at privacy@statenational.com, please provide the state that you are writing from, accompanied with documentation you may have regarding the matter you are appealing. If your jurisdiction allows you to file a complaint with the state’s Attorney General’s Office regarding any concerns with the result of your appeal request, you may do so by using the following links as may be applicable to you.
